In response to the COVID-19 pandemic WorkSafe has imposed a temporary freeze on the transfer of employer portfolios between WorkCover agents. The freeze commenced on the 1st of July 2020 and will be operational until 31 December 2020. WorkSafe will make an assessment in September 2020 to determine if the freeze should be lifted before, or continue beyond December 2020.
Employers only request to transfer their portfolio to another agent where special circumstances apply. WorkSafe has sole discretion to approve a request for an exemption should the particular circumstances deem it necessary.
Sufficient evidence (in addition to the standard transfer forms) to support the application must be provided.
The following special circumstances may be recognised by WorkSafe to give rise to an exemption:
- Before the effective date of the policy (1 July 2020), the employer was a significant way through the process of consolidating and transferring its WorkCover Insurance policy to another agent
- An existing tender for the management of an employer’s WorkCover Insurance Policy was in process (however the outcome of the tender was not known before July 1 2020)
- Due to irrevocable financial hardship experienced by an employer due to the impact of the COVID-19 pandemic, the employer has to undertake a company restructure whereby it would be like to consolidate and only have one employer with the same agent across several Australian jurisdictions.
- There has been an irretrievable breakdown between the employer and their current managing agent.
