Workplace Manslaughter and other matters Bill 2019

The Government’s Workplace Manslaughter Bill passed the Upper House of Parliament in January 2020, employers whose negligence causes a workplace death will be liable and can faces charges under the new offence that will attract penalties of up to $16.5M in fines and up to 20 years in jail.

The WSLA Bill will make amendments to the OHS Act to introduce a new criminal offence that applies where an employers’, officer of employers, or self-employed persons negligent conduct causes the death of an employee or member of the public.

The new offence aims to prevent workplace death and provide stronger deterrent for officers and organisations to comply with their occupational health and safety obligations.
